GENERAL TERMS and CANCELLATION POLICY

• These General Terms and Conditions (“General Terms”) shall apply for accommodation services rendered by SCG for its Guests (“Accommodation Agreement”).

Booking Order: Guest may place a binding booking

• Directly:

  • present with staff at the front desk (walk-ins);

  • not present

    • via email ([email protected]);

    • via booking tool on our website (www.guanico.com); or

• indirectly via channel:

  • Booking.com

  • Expedia.com

  • Hostelworld.com

 
Other booking channels are not linked with the system of SCG and may not be used for the placement of a binding Booking Order. Usage of other booking channels will not create a binding Accommodation Agreement with SCG. We do not accept any vouchers issued by third parties not linked with our booking system (see above).  
 

• The website of SCG (www.guanico.com) contains the updated and relevant services of SCG. Our website contains the valid services of SCG. Other service descriptions of other websites or service providers or any service description in a voucher issued by a third-party service provider are not relevant for this Accommodation Agreement. Any other confirmation of third parties in relation to bookings in SCG are not relevant and do not create a binding Accommodation Agreement.

Accommodation Agreement: Booking/Reservation is binding upon confirmation of booking by us (Confirmation Email). SCG reserves the right to require from customer pre-payment of the full room rate for a binding booking/reservation/agreement. In this case, wrong and incomplete credit card information provided by customer may cause unsuccessful pre-payment and thus no binding Accommodation Agreement.

Cancellation Policy: SCG makes no refund due to no-show. SCG makes a refund of 50 % of the booked room rate if cancellation is made 30 days prior to arrival date.

• SCG commits, that the acommodations shall be ready for Guests from 1 pm on the agreed date of arrival, never the less, SCG is cannot guarantee that the accomodation will be ready at 1 pm as of any reason (force majeure) event occures. SCG may charge an extra fee in the amount of USD 20 for late check-in after 9 pm. SCG is not obligated to grant accommodation for Guests arriving later than 9 pm on the agreed date of arrival.

Check-out: Check-out shall be no later than 11 am on the date of departure. SCG is entitled to charge an extra fee in the amount of USD 20 for late check out.

• SCG may provide Guests with substitute accommodation in case of over booking or operational reasons. In case of an up-grade the agreed Room Rate will not be changed. In case of a down-grade the lower Room Rate will be applied.

House Rules: Guests have the right to use the accommodation and all other facilities on the compound of SCG in accordance with the House Rules. Guests are entitled to make normal use of the rented rooms.

Damage: Guests are liable for any damage caused to SCG. SCG may charge for damages the flat amount of USD 100 (painting), USD 50 lamps, USD 200 (cooler and AC), USD 40 for electric installations and USD 50 (furniture). Further damage (if any) is not covered by the flat damage fee. The payment of the flat damage fee and the fee for further damage is due for payment on the agreed date of departure. Guests herewith authorize SCG to charge their credit card with the amount of flat damage fee and the further damage fee due.
 

• The room rates as indicated on the website of SCG include the exclusive use of the rooms for one night and the usage of all free-of-charge services of SCG (“Room Rate”). Other chargeable services of SCG (surfing, equipment, tours, AC, Yoga, gastro services, surf shop, laundry and bodega services, etc.) are not included in the room rates (“Extra Rate”) and are subject to the Price List. Rates and Extra Rates may change from time to time.

 
Standard Service Level: SCG shall provide the service level as indicated on www.guanico.com. Guests are aware that SCG focuses on the needs of surfing tourism and service levels comply with Surfing and Surfcamp standards. This includes Yoga services. However, Yoga of SCG is focused to support surfing. SCG does not provide full range yoga and yoga treatments.
 
Liability: SCG shall not be liable for any use of the facility not corresponding to the House Order and any unusual use of the infrastructure. SCG is further not liable for any values damaged, lost, stolen or forgotten at SCG. SCG is further not liable for any liability caused by third parties using the facility of SCG. The liability of SCG shall be limited to the maximum amount insured by SCG.
 
Prolongation: There is no right for any prolongation of the booked period. However, SCG shall use best efforts to provide Guests with a prolongation solution.
 
Reduction: There is no right for any reduction of the booked period. In any event of early leaving SCG shall have the right to charge the Room Rate agreed.
 
Termination: SCG shall have the right to terminate the Accommodation Agreement with immediate effect for important reasons, e.g. violation of House Order, adverse use of the rooms and the facility, intolerable behavior to staff and other guests and in events of force majeure (weather, strike, official orders, etc.).
 
Applicable Law and Place of Jurisdiction: The place of performance and jurisdiction shall be SCG and Panama. Exclusive Place of Jurisdiction is Panama.
